Dr. Kapusta s.r.o., company registration number 51168987, (“Dr. Kapusta s.r.o.”, “Mingo”, “vendor”) is a Slovakia-based company that develops, markets, and supports the software.
Mingo (“software”) is the flagship product of Dr. Kapusta s.r.o. and is used for database administration, development, and advanced searching of databases. Mingo exists in two distinct versions; Mingo Free, which is free software, and Mingo Pro, which is commercial software. Mingo Pro is licensed, not sold, and the customer needs to renew the license annually to get access to the new version. In the case of lapsed renewal, the customer has a perpetual license to keep using the software in the latest version it has received.
Dr. Kapusta s.r.o. is a B2B company, hence the vast majority of our customers are companies, organizations, or institutions. However, when you register for the download of a product, purchase licenses, make an inquiry or show interest in buying the product, register a bug, open a support ticket or make a comment on a forum on behalf of a company, organization, or institution and use our website, some personal information is required and stored. Dr. Kapusta s.r.o. collects names, e-mail addresses, licenses, financial records, support history IP addresses, activity on our website, and data provided through surveys, product evaluations, and other means of showing interest in the product. Any data you have voluntarily submitted in communication with Dr. Kapusta s.r.o., including but not limited to bug reports, support tickets, entries in forums, and general inquiries will also be stored. Please note that we also process other personal data about you, such as telephone number, resume, and other information you submit in your job application when you apply to a vacant position.
The information is used for the following primary purposes:

To give you introductory information about a product being downloaded and related services offered by Dr. Kapusta s.r.o. and to alert you to product upgrades, special offers, updated information, and other new services from Dr. Kapusta s.r.o. The legal basis for the processing is our legitimate interest in providing our customers with relevant information on our products and services.
To enter and manage an agreement with you or the company, organization, or institution that you represent, for example regarding commercial software licenses and temporary evaluation licenses The legal basis for the processing is to enter and/or perform a contract. In the event you represent a company, organization, or institution, the legal basis for the processing is our company’s as well as your company, organization, or institution’s legitimate interest in entering and/or fulfilling the contract.
For invoicing and financial records The legal basis for the processing is the performance of a contract. In the event you represent a company, organization, or institution, the legal basis for the processing is our company’s as well as your company, organization, or institution’s legitimate interest in fulfilling the contract.
To help us provide relevant product support The legal basis for the processing is our legitimate interest in providing our customer's product support. To facilitate a user forum or similar function where users may communicate peer-to-peer and with Dr. Kapusta s.r.o..
To save material concerning bookkeeping and tax. The legal basis for the processing is to fulfill our accounting and tax legal obligations.
As we only communicate with users on matters closely related to their use of our software and services, Dr. Kapusta s.r.o. does not ask for any consent to send you information, nor do we maintain any such registry.
A Mingo license needs to be renewed annually to provide access to new versions. If a customer fails to renew, the customer still has a perpetual license to use their then current version of the software. Dr. Kapusta s.r.o., at its discretion, may allow customers with lapsed licenses to renew without back charges to get back to access the latest versions.
This means that license data, financial records, and related material are kept as long as the customer has a license of any kind of software. Dr. Kapusta s.r.o. will delete all data pertaining to the customer and its users and contact persons if and after a customer voluntarily cedes its perpetual license and deletes all copies of Mingo and confirm this in writing to Mingo.io.
Data not related to licenses, financial records, and support history will be purged no later than 24 months after collection. Data relating to your job application will be deleted after the recruitment process has been completed.
If at any time you wish to be removed from our database, simply send an email with the subject "remove" to info@mingo.com and we will promptly cancel records that are not needed for the fulfillment of our legal obligations as described below. If you represent a company, organization, or institution, please provide relevant contact information for a new contact person. Please note that we may not be able to provide you or the company, organization, or institution you represent the Mingo and related services in the event that you wish to have your personal data deleted. This includes the fallback perpetual license to keep using the software after the license period expires. Please see section 11. Termination in the EULA for details.
If considered necessary to comply with legal obligations or for the establishment, exercise, or defense of legal claims, personal data may be stored for a longer period. For example, personal data relating to your job application may be stored for two years after the alleged act was taken or should have been taken such as to defend ourselves against claims concerning violations of the Slovak Discrimination Act. Further, for bookkeeping purposes, personal data will be stored for seven years, counting from the end of the calendar year during which the financial year, to which the information pertained, was terminated, in accordance with the Slovak Accounting Act.

Mingo is concerned with the security of the personal data which we have collected and has put in place measures to prevent unauthorized access to that information. For example, we exclusively use encrypted web traffic (https://).
We may assign the processing listed above to a partner or supplier acting as sub-processors, e.g. providers of IT services and cloud services. Such processing will not be made for other purposes than as described in this Privacy Policy.
We may also share personal data about you with companies in our group and, if and to the extent, we are under a legal obligation to do so, to authorities. We may also, in connection with mergers, acquisitions, or divestiture of all or parts of our business, share your personal data with the acquiring entity as well as its consultants. Please note that this Privacy Policy does not apply to the processing of personal data of recipients acting as data controllers.
We may transfer your personal data to countries outside the EU/EEA. If personal data is transferred to a country outside the EU/EEA, we will take measures to ensure that the personal data continues to be protected and will take the necessary measures to ensure a legal transfer of the personal data to countries outside the EU/EEA.
If you buy Mingo licenses online, you do it from our website and processed by USA-based Paddle.com inc. Paddle.com acts as a reseller and is, in itself, a GDPR-compliant data controller in GDPR terminology why this Privacy Policy does not apply. When customer data is communicated between Paddle.com and Mingo software, it is protected by TLS encryption.
This Privacy Policy is current as of the date set forth above. We may change this Privacy Policy from time to time. We will post any changes to this Privacy Policy on our website. If we make any changes to this Privacy Policy that materially affect our practices with regards to the personal information we have previously collected from you and you or the company, organization, or institution you represent is a customer, we will notify you by e-mail.
You have the right to:
Request information about which of your Personal Data we process and you can request a copy of these;
Have incorrect Personal Data rectified and you can under certain circumstances have your Personal Data erased;
Oppose against certain processing of your Personal Data and request that the processing is restricted; and
Have your Personal Data transferred to another controller (right to data portability).
In the event that we use legitimate interest as a legal basis for the processing of your personal data, you can obtain information on the balancing test that we have performed for the processing upon request.

You may at any time obtain, erase or restrict the processing of your Personal Data.
